Beware of “Dodgy Dave” Migration Scams: Protect Your Australian Visa

Beware of “Dodgy Dave” Migration Scams: Protect Your Australian Visa

Applying for an Australian visa can be a life-changing opportunity, but it can also make applicants vulnerable to individuals who exploit uncertainty and misinformation.

The Australian Department of Home Affairs has issued a strong warning about so-called “Dodgy Dave” operators. These are individuals who unlawfully charge migrants for immigration assistance without being legally authorised to do so. Their actions often leave visa applicants out of pocket, facing visa refusals, cancellations, or even long-term consequences that could affect their future in Australia.

As government enforcement intensifies across the country, visa applicants are being urged to seek advice only from qualified migration professionals.

Government Cracks Down on Unlawful Migration Advisers

The Department of Home Affairs, together with the Australian Border Force (ABF) and other government agencies, has increased enforcement efforts against illegal migration advisers.

Recent multi-agency operations uncovered several unlawful operators who collectively defrauded visa applicants of more than $1.4 million. Many of these individuals targeted vulnerable migrants through social media, messaging platforms and community networks by promising guaranteed visa outcomes or “special connections” within the Department.

Some operators encouraged applicants to lodge visa applications containing false or misleading information, including unsupported Protection visa claims, simply to obtain a Bridging Visa with temporary work rights.

These practices place migrants at significant legal risk.

The Serious Consequences of Following Bad Advice

Submitting false or misleading information in a visa application can have severe consequences under Australian migration law.

Depending on the circumstances, applicants may face:

  • Visa refusal
  • Visa cancellation
  • Exclusion periods that prevent future visa applications
  • Investigation for migration fraud
  • Significant fines
  • Criminal penalties, including imprisonment in serious cases

Even when incorrect information is provided at the direction of an unlawful adviser, visa applicants remain responsible for the accuracy of their applications.

How to spot a “Dodgy Dave” Operator

Knowing what to look for can help you avoid becoming a victim of migration fraud.

Be cautious if someone:

  • Requests payment to “register your interest” or asks you to transfer visa fees into their personal bank account.
  • Keeps your passport, birth certificate or other original identity documents.
  • Guarantees visa approval or claims they have a special relationship with the Department of Home Affairs.
  • Encourages you to exaggerate or fabricate your employment history, qualifications, relationship status or other personal information.
  • Discourages you from reviewing your own visa application before it is lodged.

No adviser can guarantee that a visa will be approved. Every application is assessed by the Department of Home Affairs based on Australian migration law and the evidence provided.

Who Can Legally Provide Immigration Assistance?

In Australia, it is unlawful for a person to charge a fee for immigration assistance unless they are legally authorised to do so.

Before engaging anyone, confirm they fall within one of these categories.

Registered Migration Agents

Registered Migration Agents (RMAs) must be registered with the Office of the Migration Agents Registration Authority (OMARA). They are required to comply with a professional Code of Conduct and maintain current knowledge of Australia’s migration framework.

Australian Legal Practitioners

Australian lawyers who hold a current practising certificate are authorised to provide immigration legal advice and represent clients in migration matters. Their practising status can be verified through the relevant state or territory legal regulator.

Report Suspected Migration Scams

If you believe someone is unlawfully providing immigration assistance or operating a visa scam, you can report them anonymously through the Australian Border Force’s Border Watch program.

Reporting suspicious activity helps protect other migrants and supports the integrity of Australia’s migration system.
